1. Introduction

These Terms and Conditions govern access to and use of the online store Sex Shop EU, as well as purchases made through the website sexshopeu.com.

By placing an order through the website, you agree to these Terms and Conditions. Please read them carefully before completing your purchase.

These Terms and Conditions apply to purchases made by consumers through our online store. Any professional, wholesale, distribution, retail, or other B2B arrangement must be expressly agreed separately in writing and may be subject to different conditions.

SS EU may be used as a discreet abbreviated name in transactional emails and other order-related communications. The name shown on a bank, card, or payment account statement may vary depending on the payment method and provider.

3. Adults Only

Sex Shop EU sells adult products. The website and the products sold through it are intended only for adults who are at least 18 years old or the age of majority in their jurisdiction, whichever is higher.

By accessing the website and placing an order, you confirm that you meet the required legal age and that the purchase, possession, import, and use of the products are lawful in your location.

We may refuse, suspend, or cancel an order where we have reasonable grounds to believe that the customer is underage, that the order was placed on behalf of an underage person, or that the order may breach applicable law.

4. Products and Product Information

We make reasonable efforts to display product descriptions, images, prices, materials, dimensions, compatibility information, availability, warnings, and other relevant information accurately.

Product images may vary slightly from the product received because of lighting, screen settings, packaging updates, supplier changes, manufacturing tolerances, or minor design variations that do not affect the essential characteristics of the product.

Please review the product description, instructions, warnings, materials, dimensions, and compatibility information before purchasing and using a product.

All products are subject to availability. If a product becomes unavailable after an order is placed, we will contact you as soon as reasonably possible and offer an appropriate solution, such as waiting for availability, replacing the product where suitable and agreed, cancelling the affected item, or issuing a refund.

5. Ordering Process and Electronic Contract

To place an order, you must select the products you wish to purchase, add them to your cart, provide the requested contact, billing, and delivery information, select an available shipping and payment method, review the order, and confirm the purchase.

Before confirming the order, you can review and correct the information entered, including products, quantities, contact details, delivery details, billing information, and the selected payment and shipping methods.

After placing an order, you will receive an order confirmation by email. Unless the message expressly states that payment is pending or that further action is required, the contract is concluded when the order confirmation is sent. This does not prevent us from cancelling and refunding an order where there is product unavailability, payment failure, suspected fraud, an obvious pricing error, incorrect or incomplete information, legal restrictions, or another lawful reason described in these Terms.

The language currently available for the online contracting process is English, unless another language is expressly made available through the website or checkout.

Order and transaction records are stored electronically by us and by service providers used to operate the store, including Shopify, for operational, accounting, legal, fraud-prevention, and customer-service purposes. You may access available order information through your order-status link or customer account, where enabled, or request a copy by contacting us.

You may save or print these Terms and Conditions before placing an order. The version applicable to your purchase is the version available when the order is placed.

6. Prices, Taxes, and Payment

Prices are displayed in euros and include applicable taxes where required.

Shipping costs and any other applicable charges are shown before the order is confirmed. The total price, including products, applicable taxes, and shipping, is displayed before payment.

Prices may change at any time, but changes will not affect orders already confirmed, except where there is an obvious pricing or technical error.

Payment methods available at checkout may include:

  • Visa, Mastercard, and American Express credit or debit cards processed through Shopify Payments.
  • PayPal through PayPal Express Checkout.
  • Other payment methods that may be enabled and displayed at checkout from time to time.

Only the payment methods displayed at checkout are available for a particular order. Availability may depend on the destination, order value, device, currency, technical availability, security checks, and approval by the relevant payment provider.

Card payments processed through Shopify Payments and payments made through PayPal are subject to the terms, privacy notices, security checks, and eligibility requirements of the relevant provider.

We do not receive or store full payment-card details. Payment information is transmitted securely to the relevant payment provider for authorisation and processing.

A payment may be declined, delayed, reviewed, reversed, or cancelled by the payment provider or by us for security, fraud-prevention, legal, regulatory, or compliance reasons.

Payment must be completed before an order is processed and shipped, unless another arrangement is expressly agreed.

The wording shown on a bank, card, or PayPal account statement may vary depending on the chosen payment method and provider. Where supported, SS EU may be used as a discreet statement descriptor, but the exact wording is determined by the payment provider and may include additional provider information.

7. Shipping and Delivery

We ship only to countries and regions enabled at checkout. If a destination is not available at checkout, we do not currently ship there.

Shipping costs, available services, and estimated delivery times are displayed before the purchase is completed and are explained further in our Shipping Policy.

Estimated delivery is generally between 2 and 7 business days from order processing for supported European destinations, depending on the destination, carrier, stock preparation, and operational circumstances. Delivery estimates are not guaranteed unless expressly stated otherwise.

Orders are shipped in neutral and discreet packaging. We aim to avoid explicit references to the nature of the products on the outside of the parcel where reasonably possible. Standard information required for logistics, delivery, payment, customs, or legal compliance may still appear.

The customer is responsible for providing complete and accurate delivery information. Please check your address before confirming the purchase and contact us promptly if you notice an error.

Where we select or offer the carrier, the risk of loss or damage remains with us until you, or a person designated by you other than the carrier, take physical possession of the goods, except where applicable law provides otherwise.

If we become aware of a significant delay, failed delivery, lost shipment, or other delivery problem, we will review the circumstances and handle the matter in accordance with applicable consumer law and our Shipping Policy.

8. Order Confirmations, Receipts, and Invoices

After placing an order, you will receive an order confirmation or receipt by email containing the available purchase details.

Shipping and tracking information will normally be sent separately after the order has been dispatched and tracking becomes available.

Where legally required, or where you request one, we may issue an invoice using the information provided with the order. You are responsible for ensuring that billing information is complete and accurate.

9. Right of Withdrawal, Returns, and Refunds

Consumers generally have a legal right to withdraw from an online purchase within 14 calendar days from delivery, subject to the exceptions established by applicable law.

Because we sell intimate and hygiene-sensitive products, sealed products that are not suitable for return for health or hygiene reasons may not be returned under the right of withdrawal once they have been unsealed after delivery.

Opening the outer shipping parcel does not automatically remove the right of withdrawal. However, any product seal, hygiene seal, or protective wrapping required for health and hygiene protection must remain intact.

For an eligible withdrawal return made because the customer changed their mind, the customer is responsible for the direct cost of returning the product.

If a product is defective, damaged, incomplete, incorrect, or does not conform to the contract, the matter is handled separately under the legal guarantee, and the customer will not be required to pay reasonable return shipping costs where a return is necessary to assess or resolve the issue.

Returns, refunds, cancellations, hygiene restrictions, return costs, and the model withdrawal form are explained in detail in our Returns and Refunds Policy. Nothing in these Terms limits your statutory consumer rights.

10. Legal Guarantee of Conformity

Products sold to consumers are covered by the legal guarantee of conformity provided by applicable consumer protection law.

For new products sold in Spain, the legal guarantee period is generally 3 years from delivery.

If a product is defective, damaged, incomplete, incorrect, or does not conform to the contract, please contact us at contact@sexshopeu.com and provide your order number, a clear description of the issue, and photos or videos where reasonably relevant.

Depending on the circumstances and applicable law, remedies may include repair, replacement, a price reduction, or termination of the contract and a refund.

The legal guarantee does not cover damage caused by misuse, negligence, failure to follow instructions, improper cleaning, improper storage, normal wear and tear, accidental damage, unauthorised modification, or use with incompatible products or accessories.

11. Product Use and Safety

Products must be used only for their intended purpose and in accordance with the instructions, warnings, cleaning guidance, storage information, and safety information supplied with the product or shown on the website.

The customer is responsible for using products safely, hygienically, responsibly, and only where legally permitted.

Stop using a product if it appears damaged, overheats, behaves abnormally, causes pain or irritation, or otherwise appears unsafe. Where appropriate, consult a qualified healthcare professional.

To the extent permitted by law, Sex Shop EU is not responsible for damage or injury caused by misuse, negligent use, use contrary to instructions, unauthorised modification, improper cleaning or storage, or use by an underage person.

This section does not limit liability or consumer rights that cannot legally be excluded.

12. Promotions, Discounts, and Availability

Promotions, discounts, free-shipping offers, and special offers may be subject to specific conditions, limited duration, stock availability, minimum order values, destination restrictions, or other stated requirements.

We may modify, suspend, or withdraw promotions at any time without affecting orders already confirmed.

Discount codes may not be combined unless expressly stated. The conditions displayed with a promotion or at checkout apply to that promotion.

13. Intellectual and Industrial Property

Website content, including text, images, photographs, graphics, logos, icons, design, layout, source code, and product presentation, is owned by Sex Shop EU or used with permission from the relevant rights holders.

You may not copy, reproduce, distribute, publicly communicate, modify, publish, extract, reuse, or exploit website content for commercial purposes without prior written permission from Sex Shop EU or the relevant rights holder.

14. Acceptable Use of the Website

You agree not to use the website:

  • For unlawful, fraudulent, abusive, harmful, or unauthorised purposes.
  • If you are under the required legal age.
  • To place orders using false, incomplete, misleading, or unauthorised information.

Marketing communications will be sent only where permitted by applicable law and your consent choices. You may unsubscribe from marketing communications without affecting service-related messages.

The website and checkout may use or link to services operated by third parties, including Shopify, payment providers, carriers, analytics providers, customer-support tools, and other service providers.

Third-party services may be subject to their own terms, privacy policies, availability, eligibility requirements, and technical limitations.

We are not responsible for the content or practices of third-party websites or services that we do not control. This does not affect any responsibility that remains ours under applicable consumer law.

17. Limitation of Liability

Nothing in these Terms limits or excludes liability where it cannot legally be limited or excluded, including mandatory consumer rights, liability for defective products where applicable, fraud, wilful misconduct, or personal injury caused by negligence where liability cannot be excluded.

To the maximum extent permitted by law, Sex Shop EU is not liable for indirect or unforeseeable losses, loss of profit, loss of business, loss of data, or damage caused by misuse of products or use contrary to instructions.

This section does not reduce any mandatory remedy available to a consumer.

18. Events Outside Our Reasonable Control

We are not responsible for a failure or delay caused by events outside our reasonable control, including natural disasters, severe weather, strikes, transport disruption, supply-chain interruption, public-health emergencies, technical failures, cyber incidents, legal restrictions, carrier disruption, or acts of public authorities.

If such circumstances affect an order, we will try to inform you and find a reasonable solution. This section does not remove any mandatory right to cancellation, delivery, or refund available under applicable law.

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in effect.

22. Applicable Law and Jurisdiction

These Terms and Conditions are governed by Spanish law and, where applicable, European Union law.

If you are a consumer residing in the European Union, this choice of law does not deprive you of any mandatory consumer-protection rights that apply in your country of residence.

Disputes involving consumers will be submitted to the courts and authorities determined by applicable consumer-protection law.

If the customer acts as a business, professional, distributor, retailer, or in another non-consumer capacity, and unless otherwise required by law, the parties submit to the courts of Barcelona, Spain.
